New York Birth Injury Lawsuit Ends in $130 Million Verdict
The New York Daily News has reported that a Long Island family was recently awarded $130 million in a NY birth injury lawsuit, after their daughter was left severely brain damaged due to hospital errors in 2002. The verdict is the second largest medical malpractice award in state history. The little girl, now 10 years old, cannot walk or speak, only having the ability to hear and understand what others say to her, reports the New York Daily News.
The path to winning the lawsuit was a long one for the family. In 2009, the hospital offered them $8 million to settle out of court, but the family chose to reject the offer, as it was not nearly enough to pay for their daughter’s life-long medical care. The case then went to trial and jurors ruled in favor of the hospital, leaving the family with nothing.
After an appeal of that ruling, the first re-trial in 2012 ended in a hung jury. A second re-trial starting in March 2013, in Suffolk County Supreme Court, ended in April, ruling in favor of the family, with the jury awarding them $130 million in damages.
The family is pleased with the outcome, as it will allow their daughter to receive the best medical care available for the rest of her life, reports the New York Daily News.
New York birth injury lawsuits
In October 2012, a Pine Bush, New York mother filed a birth injury malpractice lawsuit on behalf of herself and her infant daughter in in the U.S. District Court, Southern District of New York. The plaintiff is suing Orange Regional Medical center for $5 million in damages, claiming her infant daughter suffered a left brachial plexus injury and damage to the cervical nerves of the brachial plexus, leaving her with a condition known as Erb’s Palsy. The plaintiff claims these injuries would not have occurred if the doctor would have acted correctly.
Another birth injury lawsuit involving a brachial plexus injury was been filed by a resident of Brooklyn, New York, in May 2013. The plaintiff claims that negligent acts by the Brooklyn Hospital delivery room staff caused her daughter to suffer serious birth injuries. As a result of the alleged negligence, the infant was born with significant birth injuries causing right arm paralysis and Erb’s Palsy.
