It starts with the interview of sitting down and talking to the client and I want to hear everything they have to tell me. Quite often it’s cathartic for the client to explain what they’ve been through and then we start the the questioning about certain things that were done or not done for the client.
Then we obtain the client’s medical record and that’s the game changer.
You know, I myself personally go through every medical record that’s presented to this office in the medical malpractice department to see if I can find these departures from accepted standards of care. Once I have a belief in the case, then we send it to a team of experts for expert review. A medical malpractice case to go forward requires that a physician within the field has been conferred upon and agrees that there are departures from standards of care. Then the paperwork we file a summit of complaint. We wait for the answer on behalf of the doctor or the institution and then we start our paper discovery and thereafter we will get the client ready for deposition where they get to tell their story and we then depose the doctors or hospital staff medical staff to find out their story. With this in mind we prepare every medical malpractice case as if it’s going to be tried. We make sure that all the experts are knowledgeable, appropriate, and can be presented to a jury.
