The plaintiff was a passenger in a vehicle driven by her fiancé. They were driving straight and the defendant ran into them from the opposite direction. There was conflicting testimony about whether they were stopped or moving at the time of impact. The other driver said they did not know how the accident occurred.

After his second back surgery, a demand was made to the insurance carrier to tender their $ 500 K policy. A few weeks later, parties negotiated a settlement of $485K.

Attorney Mark Bernstein obtained a $325,000.00 settlement for a taxi driver whose cab was hit from behind by a construction vehicle in rear-end style collision. Our client, the taxi passenger, suffered a lower back injury that required injection therapy. He later submitted to Percutaneous Discectomy Surgery rather than a more invasive option such as open incision Fusion-type of surgery.

Prior to the Mediation Hearing, defense counsel made an offer of $40,000.00. During the mediation, our office was able to negotiate the much larger settlement amount and resolve the case without the need for trial.

She went to a chiropractor for 4 1/2 months followed by physical therapy for about 4 visits. Though an MRI came back negative, she later went to an orthopedic surgeon who described her as having cervical radiculopathy and in need of surgery. Defendants were prepared to bring in a radiologist, Dr. Mair, who indicated that plaintiff, now age 24, had a degenerative condition in her neck, although she never had treated with a doctor or had been in any accidents prior to the time of the accident.

The case was tried in just one day with respect to liability. After the liability verdict was rendered in favor of the plaintiff, the case settled for $190,000.
