Important Deadlines After a Car Accident in NYC
You must act quickly after a car crash to protect your right to compensation. If you miss any of the applicable deadlines, you may be unable to recover damages for your injuries.
State law requires you to notify your no-fault insurance company about the accident in writing as soon as possible, and no later than 30 days after the crash. If you meet New York’s serious injury threshold, you typically have three years from the date of the crash to file a fault-based personal injury lawsuit.
If a state or city government agency is responsible for your accident, you must file a Notice of Claim within 90 days of the crash. You’ll also need to file your lawsuit within one year and 90 days of the accident.
Additional deadlines apply if your accident occurred while performing your job duties. You must notify your employer within 30 days of the accident, and you have two years from the date of the injury to file a workers’ compensation claim.
