What Types of Surgical Errors Are Most Common in Medical Malpractice Lawsuits?

The most common errors in medical mal that I see are either contraindicated surgery that’s very popular overaggressive surgery, surgery that was not warranted for the particular patient’s problem. Patient had a, maybe a small cyst instead of biopsying it. Now all of a sudden the patient’s had a complete hysterectomy. We’ve litigated that case before. Surgical misadventure is unfortunately popular in the Med Mal world. They’ve now injured a structure that should have been outside the surgical field that should not have been harmed and that’s a technique type case. Many medical malpractice cases revolve around failing to appreciate the patients symptoms and not working them up properly; properly sending them for imaging studies in a timely manner. We’ve had many radiology cases where just the interpretation of radiology is wrong. I’ve litigated and tried breast cancer cases where there was no finding quote unquote on radiology yet. When the patient comes to me, not only was there a finding, it would have been typed as a stage 2 or a 2B and maybe they went through chemo and radiation unnecessarily. There are so many different things that occur in the medical malpractice world. Those are just a few examples.
