Who Is Eligible for No-Fault Benefits in New York?

The no-fault benefits that I just spoke of here in New York are for anybody who was operating a motor vehicle or who was a passenger in that motor vehicle. Also, in some circumstances, it could be a pedestrian who was struck by an automobile.

There’ll always be a no-fault carrier in any type of automobile accident to make sure that those medical bills are paid for anything, again, causally related to that automobile accident.

There are exceptions in New York where somebody is working at the time of an accident or is on the job. That’s when something called workers’ compensation sets in and takes over. That’s in lieu of no-fault benefits.

But other than when somebody’s working, if there’s an automobile accident and there is valid insurance, which there should be at all times, no-fault pays those medical bills.
