Yaz Lawsuit
Yaz Lawsuit
Thousands of women who have been harmed by dangerous oral contraceptives have already filed or are currently considering filing a Yaz lawsuit to secure fair compensation for their injuries. Launched in 2006, Yaz was marketed by Bayer Healthcare as new breed of birth control pill also capable of alleviating moderate adult acne and premenstrual dysphoric disorder.
However, since then the pills have been blamed for blood clot related injuries including deep vein thrombosis, stroke and pulmonary embolism — forming the basis of thousands of lawsuits nationwide. At The Sanders Firm, we are committed to helping those negatively impacted by their use of Yasmin and Yaz, and our product liability lawyers stand ready to protect the rights of those harmed by the negligence of its manufacturer.
History of problems with Yaz
A fourth generation birth control pill, Yaz contains drospirenone, a synthetic type of progestin that differs significantly from the hormones used in the manufacture of older versions of popular oral contraceptives. Promoted as a breakthrough for its ability to treat ancillary problems such as acne and premenstrual disorders, Yaz was the subject of widespread marketing campaigns targeted at young women. However, reports began to mount that women were suffering serious problems as a result of taking Yaz, including blood clots and pulmonary embolism that had the potential to cause stroke and sometimes even death. Higher incidence of painful gallblader disease was also reported to be a side effect of this new oral contraceptive drug.
In 2008, the FDA put Bayer on notice that it believed advertising related to Yaz was misleading. The agency warned the drug maker that its claims amounted to dangerous over-promotion of the potential benefits of the pills, that its messaging downplayed the drug’s known risks and that it also encouraged use of the pills for unapproved purposes. Bayer subsequently created television spots intended to remedy the perceived problems, but the issues did not stop there.
Several years following its approval of Yaz, the FDA announced a wide-ranging investigation into the drug’s safety. This was done in response to several studies linking Yaz to a significant increase in hazardous blood clots in comparison to traditional birth control pills containing levonorgestrel.
Ultimately, when the FDA released the outcome of its own study, it was revealed that women using Yaz were 1.5 times more likely to suffer a life-threatening blood clot than those using conventional contraceptive pills. As a result, in December of 2011, the FDA mandated changes to the warning labels on Yaz, reflecting the substantial risk of blood clots the drug had been found to pose.
In the midst of these findings, growing numbers of women have reported Yaz side effects including:
- Stroke
- Heart attack
- Pulmonary embolism
- Deep vein thrombosis
- Blood clots
- Gallbladder disease

Choosing the right Yaz attorney
Injuries resulting from the use of prescription medications are among the most disturbing circumstances a person can encounter, for a number of reasons. When we are harmed by drugs we had every reason to assume were safe, we often experience serious, often permanent damage to our faith in physicians, pharmaceutical companies and the regulatory system as a whole, leaving us wondering where to turn. When negligence in the manufacturing, design and promotion of drugs results in dangerous side effects, it is essential to seek justice.
At The Sanders Firm, our mission has always been to provide steadfast advocacy on behalf of a wide range of injury victims. We have spent over 46 years honing our craft and developing a network of industry experts, support professionals, researchers and investigators so that we can offer the most comprehensive legal representation available. Filing a Yaz lawsuit
Women everywhere who have suffered serious harm as a result of using Yaz oral contraceptives should give real consideration to the possibility of filing a product liability lawsuit to obtain financial recovery. Bayer and the makers of drugs similar to Yaz have profited greatly from the sales of these pharmaceuticals, even though their products put unsuspecting users in great danger.
At The Sanders Firm, we believe that victims of these unfair practices deserve compensation for their losses and that the companies who acted so negligently in the production and marketing of the drugs should be publicly held to account.
Though the facts underlying each Yaz lawsuit will be distinct, there are certain causes of action common to many complaints:
- Defective design and manufacturing of the drug
- Failure to warn of known risks
- Fraudulent concealment of known dangers
- Negligent misrepresentation
- Breach of express and implied warranties
The breadth of potential claims against Bayer pertaining to the manufacturing and marketing of Yaz is significant, as it provides critical avenues through which injury victims can seek compensation for the harm suffered. The side effects of Yaz are often debilitating and long-term in nature, and therefore lead to substantial economic and non-economic losses.
Success in a Yaz lawsuit can potentially yield compensation for:
- Current and future medical bills
- Ongoing treatment and therapy
- Pain and suffering
- Emotional distress
- Loss of wages
- Diminished lifetime earning capacity
- Funeral expenses in cases of wrongful death
Current status of Yaz litigation and settlements
Over the past few years, the filing of lawsuits alleging injuries due to Yaz has escalated dramatically. As a result, multidistrict litigation (MDL) was established for the purpose of consolidating such matters under the oversight of Judge David Herndon in the U.S. District Court for the Southern District of Illinois.
Over 11,000 individual suits have been brought together in the MDL, and real progress toward resolution of many of them has been taking place. As of February of this year, Bayer had negotiated settlement agreements with over 8,000 plaintiffs and expects to pay roughly $1.7 billion in total to resolve a large portion of cases related to blood clots and similar side effects. The drug maker has also earmarked nearly $24 million to resolve claims pertaining to gallbladder injuries.
While these numbers are staggering in size, the dollar amount does not evidence resolution of all outstanding lawsuits. Litigation and settlement discussions are ongoing and Bayer intends to examine each case individually before entering into negotiations. Therefore, victims who have yet to file suit and pursue compensation for their Yaz-related injuries still have an opportunity to do so.
