The prime damages in a nursing home case are pain and suffering, conscious pain and suffering. And that’s the art form of the trial lawyer. The way we do this is through the questioning and answering of witnesses. Obviously, it’s photographs, but it also starts in jury selection, picking the right juror. What is the person who is going to be receptive to an injured party? That’s something that trial lawyers truly appreciate, who is going to sit in judgment of the case, because a jury makes the determination of how much compensation, if any, the injured party receives. So you have to convince them.
We do it with photographs, sometimes video, and obviously witnesses, including family. But the coup de grâce is at the end of the case, when the plaintiff gets the last word. I will always sum up last on behalf of that family, and we paint the picture. Juries should feel what the person lying in that bed felt. That’s our objective.
