Defendant Runs Red Light

This case involved a 42-year-old man who was in a car accident while on the job. On November 16, 2012, our client was traveling straight on Peninsula Boulevard when the defendant ran a red light and struck our client’s vehicle.

We obtained a statement from an independent witness verifying that the defendant did in fact run the red light. As a result of the accident the client was taken to Mercy Hospital and began treatment.

He subsequently underwent left shoulder surgery to repair a tear in his shoulder. He also had a lumbar discectomy. The discectomy did not work and he underwent a second lumbar discectomy and fusion surgery about 4 months later.

After his second back surgery, a demand was made to the insurance carrier to tender their $500k policy. A few weeks later, parties negotiated a settlement of $485k.
