At The Sanders Law Firm, we understand that serious premises liability cases often require more than simply identifying a dangerous condition. When property owners or insurance companies dispute responsibility, a thorough investigation and a willingness to take a case to trial can be critical to securing compensation. In one of the most memorable cases of his career, our senior partner, Marc Grossman, helped secure a recovery of approximately $20 million for a woman who became quadriplegic following a swimming pool accident.
The client suffered a severe spinal cord injury after diving into a swimming pool in New Jersey, leaving her quadriplegic. When she initially sought compensation, the insurance company denied responsibility and refused to provide financial assistance, including funds for a wheelchair-accessible van.
The insurer claimed that she had been drinking and had entered the shallow end of the pool, arguing that she was entirely responsible for her injuries. Rather than accepting the insurance company’s account, Marc Grossman examined the circumstances surrounding the accident to determine whether unsafe property conditions had contributed to her injuries.
During a visit to the pool, Marc noticed that the lettering on the depth markers throughout the swimming pool had become worn. After obtaining footage from the party the client had attended, Marc gathered evidence demonstrating that the pool’s depth markings were insufficient. This evidence became central to establishing liability and challenging the insurance company’s position that the client was solely responsible for the accident.
Marc took the case to trial, successfully established liability, and ultimately secured a recovery of approximately $20 million.
