I spoke about no-fault insurance as it applies to automobiles. Motorcyclists do not generally fall within no-fault here in New York. A motorcycle is not an automobile by definition.
However, motorcycle owners can purchase and obtain insurance that covers them. But it is not the norm. It is not the regular thing. It has a whole other level of discovery and investigation that’s required to see what type of insurance somebody with a motorcycle had.
So, while somebody who owns and rides a motorcycle can take out that insurance, in a lot of cases, they won’t have it because it does not fall within the standard no-fault that automobiles do in New York.
The same thing applies to certain types of scooters and e-bike-type vehicles. It really depends on the speed those vehicles travel. Again, that’s another new area in the law in the last few years, with electric bikes and things of that nature.
But as a general rule, motorcyclists will not have no-fault and do not fall within the no-fault law of the State of New York.
