Pedestrian Accident

Our client was a very active 40-year old woman who worked as a banker. She underwent multiple surgeries and had a spinal cord stimulator implanted into her back to try to reduce the pain, to no avail.

Slip & Fall Accident

Our client, a 60-year old painter, fell down her apartment steps that she had used for over 10 years without incident. She suffered a bad compound ankle injury that required multiple surgeries and rehabilitation. She also underwent skin grafts and was told she would require further surgery.

Pedestrian Accident

This case involved a “Zone of Danger” claim for a mother who saw her son cross within the crosswalk and get hit by a truck. Tragically, the boy died within seconds without any signs of life and therefore, under NY State law, minimal damages were available for his pain and suffering. However, the mother had a claim for being within the Zone of Danger which we were able to receive a settlement for.

Slip and Fall

Our client, a 45-year old woman, was shopping at JC Penney at the Roosevelt Field Mall and fell on a 1 inch raised tile floor in the woman’s department. She required a total knee replacement. We were able to achieve this significant settlement by hiring an engineer and showing how this accident could have been avoided by use of a rubber molding to make a ramp type of joint.

The settlement was achieved by senior partner E. David Woycik Jr, attorney Matt Kittrell, and senior paralegal Katie Ramos.

Car Accidents

Our client was a back seat passenger in a vehicle that was rear ended by a cement truck in the Bronx. She suffered neck and back injuries that required surgeries. She was an avid animal rights advocate and saved hundreds of animals before this accident changed her life.

The $2.1 million settlement was obtained by senior partner E. David Woycik Jr, attorney Matt Kittrell, and senior paralegal Katie Ramos.

She underwent multiple surgeries and had a spinal cord stimulator implanted into her back to try to reduce the pain, to no avail.

The driver claimed she ran out into the street without looking. However, a trial team consisting of senior partner E. David Woycik Jr, attorney Matt Kittrell, and senior paralegal Katie Ramos was able to secure a video that showed she did not run out and had looked both ways before attempting to cross the street.

Pedestrian Accidents

Our client, a 20-year old supermarket clerk, was hit by a police car that we claimed ran a red light. He had surgery and said he could not work as a result of the accident.

The trial team of senior partner E. David Woycik Jr, attorney Matt Kittrell, and senior paralegal Katie Ramos was able to show that the police car’s front passenger indicated the driver got sick, causing this accident. The City of New York offered a $1.9 million settlement before depositions.

Our client, a 60-year old painter, fell down her apartment steps that she had used for over 10 years without incident. She suffered a bad compound ankle injury that required multiple surgeries and rehabilitation. She also underwent skin grafts and was told she would require further surgery.

We employed experts who found no code violations for the steps in question since the building was a prewar building. The owner was a Greek dual citizen who did not make a good witness and could not produce any records for the stairs in question. Senior partner E. David Woycik Jr, attorney Matt Kittrell, and paralegal Katie Ramos handled this case.

Bus Accident

Our client was driving in Suffolk County when she was T-boned by a bus. She sustained neck and shoulder injuries and claimed memory and concentration issues as a result of hitting her head on the head rest. She continued working but said she experienced daily headaches and problems doing household chores. Senior partner E. David Woycik Jr, attorney Matt Kittrell, and senior paralegal Katie Ramos worked on the case.

$900K

Pedestrian Accidents

This case involved a 62-year-old female home attendant who was crossing the street on her way to work on November 3, 2011. As she was crossing Amsterdam Avenue pedestrian walk signal, the defendant made a left turn from the cross street onto Amsterdam and stuck her. Plaintiff had lumbar vertebrectomy surgery for her injuries. She never returned to work and currently uses a cane.

After depositions were held and demands made upon the insurance carrier to tender their $1,250,000 in coverage, the case was transferred to trial firm veterans, Mark Bernstein and Jennifer Gerdes to prepare for trial. The key to the settlement was that we had done all the work and we were ready to pick a jury. The insurance company faced the possibility of an excess verdict. The client received a great deal of money without having to be exposed to what a jury might have decided. More negotiations were held until parties agreed to settle the pedestrian accident lawsuit for $900K. Importantly, our attorneys were able to reduce a $200,000 lien owed by our client down to zero. Mr. Bernstein and Mrs. Gerdes were especially satisfied with this settlement because their efforts allowed our client to keep an additional $200,000 which otherwise would have been paid back to a private health insurance company.

$600K

Car Accidents

Our client, a local doctor, required a hip replacement after she was T-boned by a garbage truck that was unable to stop for a red light. After securing summary judgment on liability, senior partner Joseph Viener resolved the case at mediation for $600,000.

$500K

Car Accidents

The plaintiff was a passenger in a vehicle driven by her fiancé. They were driving straight and the defendant ran into them from the opposite direction. There was conflicting testimony about whether they were stopped or moving at the time of impact. The other driver said they did not know how the accident occurred.

Our client suffered a traumatic brain injury that led to post-concussion syndrome. She also suffered cervical spine injuries and right shoulder injuries. The defendant’s insurance company paid $100,000. An additional $400,000 was obtained from an underinsured motorist policy for a total settlement of $500,000.
