Mr. Martinez was a 42-year old truck driver whose truck was struck in the rear while he was working. As a result of the impact and the movement of his knee inside the vehicle, which included his knee striking the interior of the vehicle, Mr. Martinez suffered a tear in his left knee.
After conducting depositions in the case and preparing for arbitration on the underinsurance claim, the case was settled for the total sum of $185,000. $25,000.00 was paid by the car that caused the accident as that was their full policy. An additional $160,000 was paid by the client’s carrier as part of the Supplemental Uninsured Motorist (SUM) portion of the policy.
