Premises Liability Lawsuit Settles

ELEVATED INFANT BLOOD LEAD LEVEL

Senior Partner Martin Block recently settled a case  at a mediation where an infant 9 ½ months old had an elevated blood lead level. At the highest level, the infant measured 12.8mcg/dl.

There were serious liability problems as the defendant claimed that it was a two family house not a multiple dwelling covered by Local Law 1, and that there was no lead in the apartment.

Our client argued that there was an illegal third apartment in the building wherein lead was found on the radiators.

This premises liability settlement amounted to $150,000.
